O Superior Tribunal de Justi\u00e7a j\u00e1 consolidou o entendimento de que a aus\u00eancia desse registro constitui um v\u00edcio processual insan\u00e1vel.<\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"font-family: arial, helvetica, sans-serif;\">Com base nesse entendimento, o juiz substituto Thiago Mehari, da 4\u00aa Vara C\u00edvel e de Recupera\u00e7\u00e3o de Empresas de Rio Verde (GO), rejeitou o pedido de recupera\u00e7\u00e3o judicial de um agricultor que atuava como pessoa f\u00edsica e n\u00e3o tinha registro na junta comercial goiana.<\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"font-family: arial, helvetica, sans-serif;\">Inicialmente, o ju\u00edzo de primeira inst\u00e2ncia havia deferido o processamento da recupera\u00e7\u00e3o judicial. A decis\u00e3o, proferida por outro magistrado, havia autorizado fase administrativa da recupera\u00e7\u00e3o, com a nomea\u00e7\u00e3o de um administrador judicial e a publica\u00e7\u00e3o dos editais.<\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"font-family: arial, helvetica, sans-serif;\">A medida, por\u00e9m, acabou revertida em embargos de declara\u00e7\u00e3o ajuizados por credores \u2014 um banco.
