Segundo o dispositivo, \u00e9 vedado mudar o sujeito passivo da execu\u00e7\u00e3o, assim como incluir um novo devedor.<\/span><\/p>\n<p style=\"text-align: justify;\"><!--more--><\/p>\n<p style=\"text-align: justify;\"><span style=\"font-family: arial, helvetica, sans-serif; font-size: 12pt;\">Com esse fundamento, a ju\u00edza Nat\u00e1lia Strzykalski, da Comarca de Caraguatatuba (SP), extinguiu uma execu\u00e7\u00e3o fiscal de IPTU contra duas pessoas que morreram antes da cita\u00e7\u00e3o v\u00e1lida.<\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"font-family: arial, helvetica, sans-serif; font-size: 12pt;\">A decis\u00e3o foi provocada por exce\u00e7\u00e3o de pr\u00e9-executividade apresentada pelo esp\u00f3lio de um dos executados, que alegou nulidade da cita\u00e7\u00e3o por indica\u00e7\u00e3o de endere\u00e7o incorreto, prescri\u00e7\u00e3o intercorrente com base no artigo 40 da Lei 6.830\/1980 e impossibilidade de substitui\u00e7\u00e3o da certid\u00e3o de d\u00edvida ativa em raz\u00e3o da morte do executado antes da cita\u00e7\u00e3o.<\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"font-family: arial, helvetica, sans-serif; font-size: 12pt;\">A julgadora, em sua decis\u00e3o, destacou que as certid\u00f5es de \u00f3bito apresentadas pelo esp\u00f3lio demonstram que os executados morreram antes da cita\u00e7\u00e3o v\u00e1lida.
