O tema ser\u00e1 analisado no Recurso Extraordin\u00e1rio (RE) 1.554.371, que teve repercuss\u00e3o geral reconhecida por unanimidade. A decis\u00e3o, ainda sem data marcada, dever\u00e1 orientar todos os processos semelhantes em andamento no pa\u00eds.<\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"font-family: arial, helvetica, sans-serif; font-size: 12pt;\">O recurso foi apresentado pelo ex-deputado estadual Chico Bulh\u00f5es contra decis\u00e3o do Tribunal de Justi\u00e7a do Rio de Janeiro (TJ-RJ), que validou a Lei estadual 8.795\/2020. A norma fluminense responsabiliza intermedi\u00e1rios financeiros e plataformas de marketplace pelo recolhimento do ICMS quando n\u00e3o houver emiss\u00e3o de nota fiscal ou em caso de descumprimento de obriga\u00e7\u00f5es acess\u00f3rias.<\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"font-family: arial, helvetica, sans-serif; font-size: 12pt;\">Segundo o autor da a\u00e7\u00e3o, a lei estadual extrapolou sua compet\u00eancia ao criar novas hip\u00f3teses de responsabilidade tribut\u00e1ria, o que s\u00f3 poderia ser feito por lei complementar federal.<\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"font-family: arial, helvetica, sans-serif; font-size: 12pt;\">Ao propor a repercuss\u00e3o geral, o relator do caso, ministro Luiz Fux, destacou a relev\u00e2ncia da discuss\u00e3o.
