A pejotiza\u00e7\u00e3o \u00e9 a contrata\u00e7\u00e3o de trabalhadores aut\u00f4nomos ou pessoa jur\u00eddica para a presta\u00e7\u00e3o de servi\u00e7os.<\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"font-family: arial, helvetica, sans-serif; font-size: 12pt;\">O esclarecimento do ministro consta em um processo que discute a licitude da pejotiza\u00e7\u00e3o (ARE 1532603) e envolve a Prudential do Brasil Seguros de Vida. Se essa pr\u00e1tica for considerada ilegal, o reconhecimento do v\u00ednculo de emprego daria a trabalhadores o direito de receber diversas verbas, como o d\u00e9cimo terceiro e o ter\u00e7o de f\u00e9rias.<\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"font-family: arial, helvetica, sans-serif; font-size: 12pt;\">De acordo com Gilmar Mendes, processos que tratam especificamente sobre rela\u00e7\u00f5es estabelecidas por meio de aplicativos n\u00e3o est\u00e3o abrangidas pela suspens\u00e3o nacional determinada para a pejotiza\u00e7\u00e3o. No m\u00eas de abril, o ministro determinou a suspens\u00e3o de todos os processos sobre o tema at\u00e9 que o plen\u00e1rio julgue a\u00e7\u00e3o sobre o tema.<\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"font-family: arial, helvetica, sans-serif; font-size: 12pt;\">Essa suspens\u00e3o vale, contudo, para processos que discutem a validade dos contratos de franquia.<\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"font-family: arial, helvetica, sans-serif; font-size: 12pt;\">O relator afirma, na decis\u00e3o, que as rela\u00e7\u00f5es de trabalho mediadas por aplicativos tangenciam o debate, mas t\u00eam especificidades que justificam uma an\u00e1lise em separado.
