{"id":53579,"date":"2025-07-25T10:13:50","date_gmt":"2025-07-25T13:13:50","guid":{"rendered":"https:\/\/bonettiassociados.com.br\/?p=53579"},"modified":"2025-07-25T10:13:50","modified_gmt":"2025-07-25T13:13:50","slug":"regime-cumulativo-do-pis-e-cofins-atinge-setor-de-seguranca","status":"publish","type":"post","link":"https:\/\/bonettiassociados.com.br\/index.php\/2025\/07\/25\/regime-cumulativo-do-pis-e-cofins-atinge-setor-de-seguranca\/","title":{"rendered":"REGIME CUMULATIVO DO PIS E COFINS ATINGE SETOR DE SEGURAN\u00c7A"},"content":{"rendered":"<p style=\"text-align: justify;\"><span style=\"font-family: arial, helvetica, sans-serif;\">Nova regra tribut\u00e1ria obriga prestadores de servi\u00e7os de seguran\u00e7a e rastreamento a adotarem o regime cumulativo do PIS e COFINS.<\/span><\/p>\n<p style=\"text-align: justify;\"><!--more--><\/p>\n<p style=\"text-align: justify;\"><span style=\"font-family: arial, helvetica, sans-serif;\">A publica\u00e7\u00e3o da Lei n\u00ba 14.967\/2024 alterou o inciso I do artigo 10 da Lei n\u00ba 10.833\/2003, determinando que empresas que prestam servi\u00e7os de monitoramento eletr\u00f4nico de seguran\u00e7a, bem como rastreamento de numer\u00e1rio, bens ou valores, sejam enquadradas no regime de apura\u00e7\u00e3o cumulativa do PIS e da COFINS.<\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"font-family: arial, helvetica, sans-serif;\">A mudan\u00e7a foi confirmada por meio da Solu\u00e7\u00e3o de Consulta DISIT\/SRRF n\u00ba 4.026\/2025, da Receita Federal, e tem impacto direto na forma de c\u00e1lculo e no cr\u00e9dito tribut\u00e1rio aplic\u00e1vel a esse segmento de servi\u00e7os.<\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"font-family: arial, helvetica, sans-serif;\"><strong>O que muda com a nova lei para o setor de seguran\u00e7a e rastreamento<\/strong><\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"font-family: arial, helvetica, sans-serif;\">Antes da nova norma, muitas prestadoras de servi\u00e7os de monitoramento operavam sob o regime n\u00e3o cumulativo, especialmente quando estavam enquadradas no Lucro Real, o que permitia a apura\u00e7\u00e3o de cr\u00e9ditos relativos a insumos e outros custos operacionais.<\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"font-family: arial, helvetica, sans-serif;\">Com a altera\u00e7\u00e3o promovida pela Lei n\u00ba 14.967\/2024, essas empresas agora est\u00e3o obrigadas a seguir o regime cumulativo de apura\u00e7\u00e3o, no qual n\u00e3o h\u00e1 direito ao cr\u00e9dito de PIS\/COFINS sobre as aquisi\u00e7\u00f5es, e as al\u00edquotas aplic\u00e1veis s\u00e3o:<\/span><\/p>\n<ul style=\"text-align: justify;\">\n<li><span style=\"font-family: arial, helvetica, sans-serif;\">PIS: 0,65%<\/span><\/li>\n<li><span style=\"font-family: arial, helvetica, sans-serif;\">COFINS: 3%<\/span><\/li>\n<\/ul>\n<p style=\"text-align: justify;\"><span style=\"font-family: arial, helvetica, sans-serif;\"><strong>Servi\u00e7os atingidos pela altera\u00e7\u00e3o legislativa<\/strong><\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"font-family: arial, helvetica, sans-serif;\">A nova reda\u00e7\u00e3o do inciso I do art. 10 da Lei n\u00ba 10.833\/2003 alcan\u00e7a especificamente os seguintes servi\u00e7os:<\/span><\/p>\n<ul style=\"text-align: justify;\">\n<li><span style=\"font-family: arial, helvetica, sans-serif;\">Monitoramento de sistemas eletr\u00f4nicos de seguran\u00e7a (como c\u00e2meras, sensores, alarmes, cerca el\u00e9trica e aplicativos de vigil\u00e2ncia);<\/span><\/li>\n<\/ul>\n<p style=\"text-align: justify;\"><span style=\"font-family: arial, helvetica, sans-serif;\">Rastreamento de numer\u00e1rio, bens ou valores, incluindo solu\u00e7\u00f5es de seguran\u00e7a para transporte de cargas, ve\u00edculos e pessoas.<\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"font-family: arial, helvetica, sans-serif;\"><strong>FONTE: CONT\u00c1BEIS &#8211;
