DOU 1 de 26.09.2019.<\/span><!--more--><\/p>\n<p style=\"text-align: justify;\"><span style=\"font-family: arial, helvetica, sans-serif;\">O Decreto n\u00ba 10.027\/2019 promulgou o Protocolo de Coopera\u00e7\u00e3o e Facilita\u00e7\u00e3o de Investimentos Intra-Mercosul, firmado pelo Brasil, em Buenos Aires, em 07.04.2017, na forma do seu anexo.<\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"font-family: arial, helvetica, sans-serif;\">S\u00e3o sujeitos \u00e0 aprova\u00e7\u00e3o do Congresso Nacional atos que possam resultar em revis\u00e3o do protocolo e ajustes complementares que acarretem encargos ou compromissos gravosos ao patrim\u00f4nio nacional, nos termos do inciso I do caput do art. 49 da Constitui\u00e7\u00e3o Federal\/1988 (CF\/1988).<\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"font-family: arial, helvetica, sans-serif;\">O referido ato tamb\u00e9m trata sobre medidas tribut\u00e1rias, estabelecendo, em s\u00edntese, que nenhuma disposi\u00e7\u00e3o do protocolo ser\u00e1 interpretada:<\/span><\/p>\n<ol style=\"text-align: justify;\">\n<li><span style=\"font-family: arial, helvetica, sans-serif;\">a) como uma obriga\u00e7\u00e3o de um Estado-Parte de dar a um investidor de outro Estado-Parte, em rela\u00e7\u00e3o aos seus investimentos, benef\u00edcio de qualquer tratamento, prefer\u00eancia ou privil\u00e9gio resultante de um acordo atual ou futuro para evitar a dupla tributa\u00e7\u00e3o de que um dos Estados-Parte seja parte ou venha a tornar-se parte;<\/span><\/li>\n<li><span style=\"font-family: arial, helvetica, sans-serif;\">b) de modo que impe\u00e7a a ado\u00e7\u00e3o ou a aplica\u00e7\u00e3o de qualquer medida destinada a garantir a imposi\u00e7\u00e3o ou arrecada\u00e7\u00e3o equitativa ou efetiva de tributos em conformidade com o disposto na legisla\u00e7\u00e3o dos Estados-Parte.<\/span><\/li>\n<\/ol>\n<p style=\"text-align: justify;\"><span style=\"font-family: arial, helvetica, sans-serif;\">(Decreto n\u00ba 10.027\/2019 &#8211;
