DOU de 24.09.2024.<\/span><\/p>\n<p style=\"text-align: justify;\"><!--more--><\/p>\n<p style=\"text-align: justify;\"><span style=\"font-family: arial, helvetica, sans-serif;\">A Solu\u00e7\u00e3o de Consulta COSIT n\u00ba 259\/2024 trouxe os seguintes esclarecimentos relativamente ao Regime Especial de Incentivos para o Desenvolvimento da Infraestrutura (Reidi):<\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"font-family: arial, helvetica, sans-serif;\">a) a habilita\u00e7\u00e3o no Reidi deve ser requerida pela pessoa jur\u00eddica que vier a executar o projeto para implanta\u00e7\u00e3o da obra de infraestrutura, a qual, ap\u00f3s conclu\u00edda, necessariamente deve ser incorporada ao seu ativo imobilizado;<\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"font-family: arial, helvetica, sans-serif;\">b) a pessoa jur\u00eddica que executa o projeto, incorporando a obra de infraestrutura ao seu ativo imobilizado, para cada projeto, corresponde a cada uma das Sociedades de Prop\u00f3sito Espec\u00edfico (SPE), subsidi\u00e1rias da Consulente;<\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"font-family: arial, helvetica, sans-serif;\">c) a portaria, a ser editada pelo Minist\u00e9rio respons\u00e1vel pelo setor de infraestrutura favorecido, e a Resolu\u00e7\u00e3o da Ag\u00eancia Nacional de Energia El\u00e9trica (Aneel), devem conter a indica\u00e7\u00e3o da pessoa jur\u00eddica executora do projeto, que corresponde a cada SPE;<\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"font-family: arial, helvetica, sans-serif;\">d) no procedimento de habilita\u00e7\u00e3o no Reidi, o requerimento apresentado pela pessoa jur\u00eddica executora da obra de infraestrutura, que corresponde a cada SPE, a quem tamb\u00e9m incumbe incorpor\u00e1-la ao seu ativo imobilizado, deve vir acompanhado de c\u00f3pia da portaria editada pelo Minist\u00e9rio respons\u00e1vel pelo setor de infraestrutura a que se refere o projeto, e da Resolu\u00e7\u00e3o da Aneel, tendo ambos os atos como favorecida a mesma pessoa jur\u00eddica requerente;<\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"font-family: arial, helvetica, sans-serif;\">e) cada SPE, respons\u00e1vel pela execu\u00e7\u00e3o de seu projeto e pela incorpora\u00e7\u00e3o ao seu ativo imobilizado da respectiva obra de implanta\u00e7\u00e3o de infraestrutura, dever\u00e1 solicitar habilita\u00e7\u00e3o separadamente por projeto a que estiver vinculada.<\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"font-family: arial, helvetica, sans-serif;\">(Solu\u00e7\u00e3o de Consulta COSIT n\u00ba 259\/2024 &#8211;
