Com este entendimento, a 7\u00aa Turma do Tribunal Regional Federal da 1\u00aa Regi\u00e3o deu provimento \u00e0 apela\u00e7\u00e3o de um parlamentar contra a senten\u00e7a do Ju\u00edzo Federal da 2\u00aa Vara da Subse\u00e7\u00e3o Judici\u00e1ria de Rio Branco, que julgou improcedente o pedido que objetivava a anula\u00e7\u00e3o de lan\u00e7amento fiscal sobre verbas de gabinete.<\/span><!--more--><\/p>\n<p style=\"text-align: justify;\"><span style=\"font-family: arial, helvetica, sans-serif;\">O autor da a\u00e7\u00e3o disse que cabia \u00e0 Assembleia Legislativa do Estado do Acre a reten\u00e7\u00e3o do imposto de renda sobre os valores recebidos pelos parlamentares estaduais. Ademais, alegou que a ajuda de custo tem car\u00e1ter indenizat\u00f3rio, tendo em vista que \u00e9 destinada \u00e0 manuten\u00e7\u00e3o das despesas imprescind\u00edveis ao funcionamento e efetividade das fun\u00e7\u00f5es legislativas.<\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"font-family: arial, helvetica, sans-serif;\">O relator, desembargador federal Jos\u00e9 Am\u00edlcar Machado, declarou que \u201co Superior Tribunal de Justi\u00e7a vem se orientando no sentido de que as verbas de gabinete recebidas pelos parlamentares, embora pagas de modo constante, isto \u00e9, mensalmente, n\u00e3o se incorporam aos seus subs\u00eddios. Assim, n\u00e3o incide Imposto de Renda sobre as verbas recebidas por parlamentar correspondentes \u00e0 ajuda de custo objetivando cobrir despesas com a administra\u00e7\u00e3o de seu pr\u00f3prio gabinete\u201d.<\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"font-family: arial, helvetica, sans-serif;\">O colegiado, acompanhando o voto do relator, reconheceu o car\u00e1ter indenizat\u00f3rio dos valores recebidos pelo autor e deu provimento \u00e0 a\u00e7\u00e3o.
