DOU 1 de 19.07.2019.<\/span><!--more--><\/p>\n<p style=\"text-align: justify;\"><span style=\"font-family: arial, helvetica, sans-serif;\">A norma em refer\u00eancia alterou a Portaria RFB n\u00ba 1.098\/2013, que disp\u00f5e sobre atos administrativos no \u00e2mbito da Secretaria Especial da Receita Federal do Brasil (RFB), e a Portaria RFB n\u00ba 1.936\/2018, relativamente \u00e0 consulta interna e \u00e0 revis\u00e3o de atos normativos elaborados pela RFB.<\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"font-family: arial, helvetica, sans-serif;\">Entre as disposi\u00e7\u00f5es ora introduzidas, destacamos que as portarias RFB de car\u00e1ter normativo s\u00e3o normas complementares de interpreta\u00e7\u00e3o, integra\u00e7\u00e3o e aplica\u00e7\u00e3o normativa de leis, tratados, conven\u00e7\u00f5es internacionais e decretos, nos termos do inciso I do art. 100 da Lei n\u00ba 5.172\/1966 (C\u00f3digo Tribut\u00e1rio Nacional &#8211; CTN), de compet\u00eancia exclusiva do Secret\u00e1rio Especial da Receita Federal do Brasil.<\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"font-family: arial, helvetica, sans-serif;\">Tamb\u00e9m foram alterados os Anexos I e III da Portaria RFB n\u00ba 1.098\/2013, os quais ficam substitu\u00eddos, respectivamente, pelos Anexos I e II da referida norma, observando-se que:<\/span><\/p>\n<ol style=\"text-align: justify;\">\n<li><span style=\"font-family: arial, helvetica, sans-serif;\">a) Anexo I: que disp\u00f5e sobre atos administrativos (que trata sobre compet\u00eancia para solucionar consultas e diverg\u00eancias);<\/span><\/li>\n<li><span style=\"font-family: arial, helvetica, sans-serif;\">b) Anexo III: que disp\u00f5e sobre comunica\u00e7\u00f5es oficiais.<\/span><\/li>\n<\/ol>\n<p style=\"text-align: justify;\"><span style=\"font-family: arial, helvetica, sans-serif;\">(Portaria RFB n\u00ba 1.234\/2019 &#8211;
