DIVULGADA SOLU\u00c7\u00c3O DE CONSULTA SOBRE IMPORTA\u00c7\u00c3O SOB ENCOMENDA E INDUSTRIALIZA\u00c7\u00c3O POR ACONDICIONAMENTO OU REACONDICIONAMENTO"},"content":{"rendered":"<p style=\"text-align: justify;\"><span style=\"font-family: arial, helvetica, sans-serif;\">Foi divulgada solu\u00e7\u00e3o de consulta da Coordena\u00e7\u00e3o-Geral do Sistema de Tributa\u00e7\u00e3o (Cosit) sobre importa\u00e7\u00e3o sob encomenda.<\/span><!--more--><\/p>\n<p style=\"text-align: justify;\"><span style=\"font-family: arial, helvetica, sans-serif;\">Considera-se opera\u00e7\u00e3o de importa\u00e7\u00e3o sob encomenda aquela em que a pessoa jur\u00eddica importadora \u00e9 contratada para promover, em seu nome e com recursos pr\u00f3prios, o despacho aduaneiro de importa\u00e7\u00e3o de mercadoria estrangeira por ela adquirida no exterior para revenda a empresa encomendante predeterminada.<\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"font-family: arial, helvetica, sans-serif;\">O fato de a pessoa jur\u00eddica importadora realizar a coloca\u00e7\u00e3o de embalagem diferente da original, com a logomarca da empresa encomendante, configurando opera\u00e7\u00e3o de industrializa\u00e7\u00e3o na modalidade acondicionamento ou reacondicionamento perante a legisla\u00e7\u00e3o do Imposto sobre Produtos Industrializados (IPI), n\u00e3o descaracteriza a modalidade de importa\u00e7\u00e3o realizada por interm\u00e9dio de terceiros definida, no \u00e2mbito da legisla\u00e7\u00e3o aduaneira, como importa\u00e7\u00e3o por encomenda.<\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"font-family: arial, helvetica, sans-serif;\">A pessoa jur\u00eddica importadora por encomenda, ao registrar a Declara\u00e7\u00e3o de Importa\u00e7\u00e3o (DI), dever\u00e1 informar, em campo pr\u00f3prio, o n\u00famero de inscri\u00e7\u00e3o da empresa encomendante no Cadastro Nacional da Pessoa Jur\u00eddica (CNPJ).<\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"font-family: arial, helvetica, sans-serif;\">Por outro lado, a coloca\u00e7\u00e3o de embalagem em produtos tributados adquiridos de terceiros, mesmo em substitui\u00e7\u00e3o \u00e0 original, salvo quando se destine ao simples transporte do produto, caracteriza industrializa\u00e7\u00e3o por acondicionamento ou reacondicionamento.<\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"font-family: arial, helvetica, sans-serif;\">(Solu\u00e7\u00e3o de Consulta Cosit n\u00ba 156\/2019 &#8211;
