{"id":2320,"date":"2019-05-16T12:09:08","date_gmt":"2019-05-16T15:09:08","guid":{"rendered":"http:\/\/bonettiassociados.com.br\/?p=2320"},"modified":"2019-05-16T12:09:08","modified_gmt":"2019-05-16T15:09:08","slug":"stj-segue-o-supremo-e-altera-tese-sobre-juros-de-mora-em-precatorios","status":"publish","type":"post","link":"https:\/\/bonettiassociados.com.br\/index.php\/2019\/05\/16\/stj-segue-o-supremo-e-altera-tese-sobre-juros-de-mora-em-precatorios\/","title":{"rendered":"STJ SEGUE O SUPREMO E ALTERA TESE SOBRE JUROS DE MORA EM PRECAT\u00d3RIOS"},"content":{"rendered":"<p style=\"text-align: justify;\"><span style=\"font-family: arial, helvetica, sans-serif;\">Em raz\u00e3o da posi\u00e7\u00e3o definida pelo Supremo Tribunal Federal, a Corte Especial do Superior Tribunal de Justi\u00e7a revisou entendimento em recurso repetitivo para estabelecer que incidem juros de mora no per\u00edodo entre os c\u00e1lculos do que \u00e9 devido pela Uni\u00e3o e a data da requisi\u00e7\u00e3o formal do pagamento.<\/span><!--more--><\/p>\n<p style=\"text-align: justify;\"><span style=\"font-family: arial, helvetica, sans-serif;\">A tese fixada pelos ministros foi a seguinte: \u201cIncidem os juros da mora no per\u00edodo compreendido entre a data da realiza\u00e7\u00e3o dos c\u00e1lculos e a da requisi\u00e7\u00e3o ou do precat\u00f3rio\u201d.<\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"font-family: arial, helvetica, sans-serif;\">O relator do recurso especial, ministro Napole\u00e3o Nunes Maia Filho, explicou que, em 2010, o STJ fixou entendimento de que n\u00e3o incidiam juros de mora em tal situa\u00e7\u00e3o. Entretanto, em 2017, o Supremo julgou a quest\u00e3o em car\u00e1ter de repercuss\u00e3o geral (RE 579.431) e decidiu pela incid\u00eancia dos juros no per\u00edodo compreendido entre a data dos c\u00e1lculos e a da requisi\u00e7\u00e3o ou do precat\u00f3rio.<\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"font-family: arial, helvetica, sans-serif;\">\u201cEntendo que a tese fixada pelo STF, quando do julgamento da quest\u00e3o constitucional supramencionada, soluciona, de forma suficiente, a controv\u00e9rsia posta em discuss\u00e3o no \u00e2mbito desta Corte Superior de Justi\u00e7a\u201d, resumiu Napole\u00e3o.
