{"id":6606,"date":"2020-01-29T13:31:38","date_gmt":"2020-01-29T16:31:38","guid":{"rendered":"http:\/\/bonettiassociados.com.br\/?p=6606"},"modified":"2020-01-29T13:31:38","modified_gmt":"2020-01-29T16:31:38","slug":"tributacao-dupla-tribunal-de-impostos-de-sp-suspende-cobranca-de-icms-sobre-streaming","status":"publish","type":"post","link":"http:\/\/bonettiassociados.com.br\/index.php\/2020\/01\/29\/tributacao-dupla-tribunal-de-impostos-de-sp-suspende-cobranca-de-icms-sobre-streaming\/","title":{"rendered":"TRIBUTA\u00c7\u00c3O DUPLA &#8211; TRIBUNAL DE IMPOSTOS DE SP SUSPENDE COBRAN\u00c7A DE ICMS SOBRE STREAMING"},"content":{"rendered":"<p style=\"text-align: justify;\"><span style=\"font-family: arial, helvetica, sans-serif;\">TIT suspendeu cobran\u00e7a de ICMS da Sky.<\/span><!--more--><\/p>\n<p style=\"text-align: justify;\"><span style=\"font-family: arial, helvetica, sans-serif;\">A 4\u00aa C\u00e2mara Julgadora do Tribunal de Impostos e Taxas (TIT) de S\u00e3o Paulo suspendeu uma cobran\u00e7a de mais de R$ 23 milh\u00f5es da Sky relativa ao Imposto Sobre Circula\u00e7\u00e3o de Mercadorias e Servi\u00e7os (ICMS).<\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"font-family: arial, helvetica, sans-serif;\">Segundo o jornal Valor Econ\u00f4mico, a defesa da empresa, feita pelos advogados Raphael Caropreso e Marco Monteiro, argumentou que a S\u00famula 334, do Superior Tribunal de Justi\u00e7a, estabelece que o imposto n\u00e3o incide sobre o servi\u00e7o de provedores de acesso \u00e0 internet.<\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"font-family: arial, helvetica, sans-serif;\">Os advogados tamb\u00e9m afirmaram que a Lei Complementar n\u00ba 116\/03, alterada em 2016, definiu a incid\u00eancia de ISS sobre as atividades que disponibilizam conte\u00fado audiovisual. A exce\u00e7\u00e3o diz respeito \u00e0 presta\u00e7\u00e3o de Servi\u00e7o de Acesso Condicionado (SeAC), que fica sujeito ao ICMS.<\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"font-family: arial, helvetica, sans-serif;\">Incorporada \u00e0 Sky Brasil Servi\u00e7os, a Sky Servi\u00e7os de Banda Larga \u00e9 autorizada a fornecer o SeAc. A Sky Online, por outro lado, transmite conte\u00fado por meio da modalidade Over the Top (OTT).\u00a0 Para os advogados, ainda de acordo com o Valor, \u00e9 necess\u00e1rio diferenciar os dois servi\u00e7os.<\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"font-family: arial, helvetica, sans-serif;\">O ICMS n\u00e3o incide sobre a modalidade OTT porque neste caso a empresa n\u00e3o fornece estrutura de telecomunica\u00e7\u00e3o.
