Embora a lei que instituiu o tributo tenha permitido o reajuste dos valores pelo Poder Executivo, o Legislativo n\u00e3o fixou balizas m\u00ednimas e m\u00e1ximas para uma eventual delega\u00e7\u00e3o tribut\u00e1ria.<\/span><!--more--><\/p>\n<p style=\"text-align: justify;\"><span style=\"font-family: arial, helvetica, sans-serif;\">Com esse entendimento, a 2\u00aa Vara Federal de Campinas decidiu deferir liminar pedida por uma empresa de pl\u00e1sticos e qu\u00edmica fina que pedia a suspens\u00e3o da taxa Siscomex majorada pela Receita Federal da Alf\u00e2ndega do Aeroporto Internacional de Viracopos.<\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"font-family: arial, helvetica, sans-serif;\">No texto, a empresa alega que na execu\u00e7\u00e3o de suas atividades sociais realiza importa\u00e7\u00f5es e est\u00e1 submetida ao recolhimento da taxa Siscomex, nos termos da Lei n\u00ba 9.716\/1998, cujo valor tem sido, no entanto, ilegalmente majorado pela Portaria MF n\u00ba 257\/2011.\u00a0<\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"font-family: arial, helvetica, sans-serif;\">Ao analisar o caso, o ju\u00edzo da 2\u00aa Vara Federal citou precedentes do Supremo Tribunal Federal sobre a mat\u00e9ria para balizar a decis\u00e3o. &#8220;A taxa Siscomex \u00e9 legal, mas a forma como ela foi reajustada foi ilegal.
