{"id":6490,"date":"2020-01-22T11:05:55","date_gmt":"2020-01-22T14:05:55","guid":{"rendered":"http:\/\/bonettiassociados.com.br\/?p=6490"},"modified":"2020-01-22T11:05:55","modified_gmt":"2020-01-22T14:05:55","slug":"administracao-tributaria-nota-de-esclarecimento","status":"publish","type":"post","link":"http:\/\/bonettiassociados.com.br\/index.php\/2020\/01\/22\/administracao-tributaria-nota-de-esclarecimento\/","title":{"rendered":"ADMINISTRA\u00c7\u00c3O TRIBUT\u00c1RIA &#8211; NOTA DE ESCLARECIMENTO"},"content":{"rendered":"<p style=\"text-align: justify;\"><span style=\"font-family: arial, helvetica, sans-serif;\">Institucional<\/span><!--more--><\/p>\n<p style=\"text-align: justify;\"><span style=\"font-family: arial, helvetica, sans-serif;\">Publicado: 21\/01\/2020 19h55<\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"font-family: arial, helvetica, sans-serif;\">\u00daltima modifica\u00e7\u00e3o: 21\/01\/2020 20h05<\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"font-family: arial, helvetica, sans-serif;\">Em rela\u00e7\u00e3o \u00e0s recentes mat\u00e9rias veiculadas na imprensa sobre a atua\u00e7\u00e3o da Receita Federal na fiscaliza\u00e7\u00e3o de pessoas jur\u00eddicas prestadoras de servi\u00e7os para empresas de comunica\u00e7\u00e3o, fazem-se necess\u00e1rios os seguintes esclarecimentos:<\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"font-family: arial, helvetica, sans-serif;\">1.A Receita Federal realiza procedimentos fiscais para verificar a regularidade e adequa\u00e7\u00e3o do instituto da &#8220;pejotiza\u00e7\u00e3o&#8221;, em in\u00fameros setores econ\u00f4micos, desde a vig\u00eancia das disposi\u00e7\u00f5es contidas no art. 129 da Lei n\u00ba 11.196, de 2005;<\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"font-family: arial, helvetica, sans-serif;\">2.TODAS AS FISCALIZA\u00c7\u00d5ES EM CURSO em diversas empresas de comunica\u00e7\u00e3o, referentes \u00e0 &#8220;pejotiza\u00e7\u00e3o\u201d de pessoas f\u00edsicas, s\u00e3o decorrentes de procedimentos fiscais planejados e iniciados nos anos de 2017 e 2018, resultando em lan\u00e7amentos tribut\u00e1rios a partir de 2019;<\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"font-family: arial, helvetica, sans-serif;\">3. Considerando a totalidade dos setores econ\u00f4micos, a \u00e1rea de Fiscaliza\u00e7\u00e3o da Receita Federal realizou entre 2017 e 2019, um total de 343 lan\u00e7amentos tribut\u00e1rios, decorrentes do desenquadramento da tributa\u00e7\u00e3o como Pessoa Jur\u00eddica.<\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"font-family: arial, helvetica, sans-serif;\">4. A Receita Federal se pauta por crit\u00e9rios t\u00e9cnicos e impessoais, completamente vinculados \u00e0 legisla\u00e7\u00e3o tribut\u00e1ria.
