O texto, publicado no Di\u00e1rio de Justi\u00e7a Eletr\u00f4nico em junho de 2026, altera o Regimento Interno do STJ para organizar o julgamento de disputas entre Uni\u00e3o, Estados, Distrito Federal, munic\u00edpios e o Comit\u00ea Gestor do IBS.<\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"font-family: arial, helvetica, sans-serif;\">(Imposto sobre Bens e Servi\u00e7os). Eis a <a href=\"https:\/\/static.poder360.com.br\/uploads\/2026\/06\/stj-1.pdf\">\u00edntegra<\/a> (PDF \u2014 174 kB).<\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"font-family: arial, helvetica, sans-serif;\">A 1\u00aa Se\u00e7\u00e3o re\u00fane os ministros da 1\u00aa e da 2\u00aa Turmas, respons\u00e1veis por direito p\u00fablico. \u00c9 nesse grupo que j\u00e1 se concentram as principais discuss\u00f5es tribut\u00e1rias do tribunal.<\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"font-family: arial, helvetica, sans-serif;\"><strong>O QUE MUDA<\/strong><\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"font-family: arial, helvetica, sans-serif;\">A reforma tribut\u00e1ria criou uma nova estrutura de cobran\u00e7a sobre o consumo.<\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"font-family: arial, helvetica, sans-serif;\">O modelo estabelece 2 tributos principais:<\/span><\/p>\n<ul style=\"text-align: justify;\">\n<li><span style=\"font-family: arial, helvetica, sans-serif;\">IBS \u2014 Imposto sobre Bens e Servi\u00e7os, compartilhado por Estados, Distrito Federal e munic\u00edpios;<\/span><\/li>\n<li><span style=\"font-family: arial, helvetica, sans-serif;\">CBS \u2014 Contribui\u00e7\u00e3o sobre Bens e Servi\u00e7os, de compet\u00eancia federal.<\/span><\/li>\n<\/ul>\n<p style=\"text-align: justify;\"><span style=\"font-family: arial, helvetica, sans-serif;\">O IBS substituir\u00e1 tributos como ICMS, dos Estados, e ISS, dos munic\u00edpios. A CBS substituir\u00e1 tributos federais, como PIS e Cofins.<\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"font-family: arial, helvetica, sans-serif;\">Como o novo sistema mexe com arrecada\u00e7\u00e3o, fiscaliza\u00e7\u00e3o e distribui\u00e7\u00e3o de receitas, a tend\u00eancia \u00e9 de que surjam disputas entre os pr\u00f3prios entes p\u00fablicos.<\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"font-family: arial, helvetica, sans-serif;\">Essas disputas n\u00e3o ser\u00e3o julgadas como a\u00e7\u00f5es comuns de contribuintes contra o Fisco. Ser\u00e3o conflitos institucionais entre Uni\u00e3o, Estados, Distrito Federal, munic\u00edpios ou o Comit\u00ea Gestor do IBS.<\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"font-family: arial, helvetica, sans-serif;\"><strong>COMO SER\u00c1 O PROCESSO<\/strong><\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"font-family: arial, helvetica, sans-serif;\">A emenda criou a classe processual \u2018Conflito Federativo\u2019, identificada pela sigla CFe. Tamb\u00e9m incluiu no Regimento Interno do STJ um cap\u00edtulo espec\u00edfico sobre o tema.<\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"font-family: arial, helvetica, sans-serif;\">Pelo texto, os conflitos federativos ser\u00e3o processados e julgados pelo procedimento comum, na falta de regras especiais na Constitui\u00e7\u00e3o ou na legisla\u00e7\u00e3o.<\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"font-family: arial, helvetica, sans-serif;\">Isso significa que a emenda n\u00e3o criou um rito totalmente novo e detalhado: organizou a compet\u00eancia interna e definiu a classe processual pela qual esses casos entrar\u00e3o no tribunal.<\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"font-family: arial, helvetica, sans-serif;\">A emenda tamb\u00e9m ampliou os poderes do relator nesses processos. O ministro respons\u00e1vel pelo caso poder\u00e1 decidir sozinho quando o conflito for inadmiss\u00edvel, estiver prejudicado ou j\u00e1 estiver coberto por entendimento consolidado.<\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"font-family: arial, helvetica, sans-serif;\"><strong>MUDAN\u00c7A DE ROTA<\/strong><\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"font-family: arial, helvetica, sans-serif;\">Hoje, grande parte das discuss\u00f5es tribut\u00e1rias chega ao STJ por recurso especial. Nesse caminho, o processo come\u00e7a na 1\u00aa inst\u00e2ncia, passa pelo tribunal local ou regional e s\u00f3 depois chega ao STJ para discutir a interpreta\u00e7\u00e3o de lei federal.<\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"font-family: arial, helvetica, sans-serif;\">Nos conflitos federativos da reforma tribut\u00e1ria, o caminho ser\u00e1 diferente. Essas a\u00e7\u00f5es ser\u00e3o de compet\u00eancia origin\u00e1ria do STJ.
