{"id":60943,"date":"2026-03-17T10:34:57","date_gmt":"2026-03-17T13:34:57","guid":{"rendered":"https:\/\/bonettiassociados.com.br\/?p=60943"},"modified":"2026-03-17T10:35:05","modified_gmt":"2026-03-17T13:35:05","slug":"receita-esclarece-retencao-de-ir-em-depositos-judiciais-e-regra-para-aliquota-zero-de-pis-e-cofins","status":"publish","type":"post","link":"http:\/\/bonettiassociados.com.br\/index.php\/2026\/03\/17\/receita-esclarece-retencao-de-ir-em-depositos-judiciais-e-regra-para-aliquota-zero-de-pis-e-cofins\/","title":{"rendered":"RECEITA ESCLARECE RETEN\u00c7\u00c3O DE IR EM DEP\u00d3SITOS JUDICIAIS E REGRA PARA AL\u00cdQUOTA ZERO DE PIS E COFINS"},"content":{"rendered":"<p style=\"text-align: justify;\"><span style=\"font-family: arial, helvetica, sans-serif;\">A Receita Federal publicou, nesta 2\u00aa feira (16.mar.2026), as\u00a0<a href=\"https:\/\/in.gov.br\/web\/dou\/-\/solucao-de-consulta-n-35-de-12-de-marco-de-2026-692757151\">Solu\u00e7\u00f5es de Consulta n\u00ba 35 e n\u00ba 36<\/a>, com esclarecimentos sobre reten\u00e7\u00e3o de Imposto de Renda e aplica\u00e7\u00e3o de al\u00edquota zero de PIS\/Pasep e Cofins.<\/span><\/p>\n<p style=\"text-align: justify;\"><!--more--><\/p>\n<p style=\"text-align: justify;\"><span style=\"font-family: arial, helvetica, sans-serif;\">Na Solu\u00e7\u00e3o de Consulta n\u00ba 35, o \u00f3rg\u00e3o definiu que, quando rendimentos decorrentes de decis\u00e3o judicial s\u00e3o depositados em ju\u00edzo na Justi\u00e7a Estadual ou Distrital, cabe \u00e0 institui\u00e7\u00e3o financeira respons\u00e1vel pelo dep\u00f3sito realizar a reten\u00e7\u00e3o do Imposto de Renda na fonte no momento do levantamento do valor, al\u00e9m de cumprir as obriga\u00e7\u00f5es acess\u00f3rias previstas para a fonte pagadora.<\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"font-family: arial, helvetica, sans-serif;\">J\u00e1 a Solu\u00e7\u00e3o de Consulta n\u00ba 36 esclarece que as mudan\u00e7as nos c\u00f3digos da Nomenclatura Comum do Mercosul (NCM), feitas para adequa\u00e7\u00e3o ao Sistema Harmonizado de 2022, n\u00e3o alteram a lista de produtos com al\u00edquota zero de PIS\/Pasep e Cofins destinados a hospitais e laborat\u00f3rios.
