O entendimento \u00e9 da 3\u00aa Turma do Superior Tribunal de Justi\u00e7a ao acolher, nesta ter\u00e7a-feira (3\/12), recurso de uma empresa mineira em fal\u00eancia.<\/span><!--more--><\/p>\n<p style=\"text-align: justify;\"><span style=\"font-family: arial, helvetica, sans-serif;\">De acordo com o jornal Valor Econ\u00f4mico, os propriet\u00e1rios da empresa alegaram que a fal\u00eancia foi decretada por irregularidade do protesto para fins falimentares. Eles sustentaram ainda que a intima\u00e7\u00e3o ocorreu por telefone e n\u00e3o por correspond\u00eancia, como define a Lei de Recupera\u00e7\u00e3o Judicial.<\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"font-family: arial, helvetica, sans-serif;\">No TJ mineiro, os desembargadores entenderam que n\u00e3o era poss\u00edvel analisar a rescis\u00f3ria por n\u00e3o ser instrumento adequado.<\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"font-family: arial, helvetica, sans-serif;\">Em decis\u00e3o monocr\u00e1tica, a relatora do caso, ministra Nancy Andrighi, havia negado a a\u00e7\u00e3o.
