{"id":20821,"date":"2021-12-17T10:08:41","date_gmt":"2021-12-17T13:08:41","guid":{"rendered":"http:\/\/bonettiassociados.com.br\/?p=20821"},"modified":"2021-12-17T10:08:41","modified_gmt":"2021-12-17T13:08:41","slug":"camara-aprova-projeto-que-regulamenta-cobranca-de-icms-em-operacao-interestadual","status":"publish","type":"post","link":"http:\/\/bonettiassociados.com.br\/index.php\/2021\/12\/17\/camara-aprova-projeto-que-regulamenta-cobranca-de-icms-em-operacao-interestadual\/","title":{"rendered":"C\u00c2MARA APROVA PROJETO QUE REGULAMENTA COBRAN\u00c7A DE ICMS EM OPERA\u00c7\u00c3O INTERESTADUAL"},"content":{"rendered":"<p style=\"text-align: justify;\"><span style=\"font-family: arial, helvetica, sans-serif;\">A C\u00e2mara dos Deputados aprovou o Projeto de Lei Complementar 32\/21, que regulamenta procedimentos para o pagamento do ICMS em opera\u00e7\u00f5es interestaduais de bens e servi\u00e7os quando o consumidor final n\u00e3o \u00e9 contribuinte do imposto<\/span><!--more--><\/p>\n<p style=\"text-align: justify;\"><span style=\"font-family: arial, helvetica, sans-serif;\">Devido \u00e0s mudan\u00e7as feitas pelo substitutivo do deputado Eduardo Bismarck, a mat\u00e9ria retorna ao Senado.<\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"font-family: arial, helvetica, sans-serif;\">A proposta procura evitar falta de regulamenta\u00e7\u00e3o a partir de 2022 em raz\u00e3o de decis\u00e3o do Supremo Tribunal Federal (STF) que considerou inconstitucionais v\u00e1rias cl\u00e1usulas do Conv\u00eanio 93\/15, do Conselho Nacional de Pol\u00edtica Fazend\u00e1ria (Confaz), o qual re\u00fane todos os secret\u00e1rios estaduais de Fazenda.<\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"font-family: arial, helvetica, sans-serif;\">O texto aprovado incluiu a obriga\u00e7\u00e3o de os estados manterem um site para o c\u00e1lculo do tributo e com informa\u00e7\u00f5es sobre cada tipo de opera\u00e7\u00e3o.<\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"font-family: arial, helvetica, sans-serif;\">Al\u00edquota efetiva<\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"font-family: arial, helvetica, sans-serif;\">A \u00fanica vota\u00e7\u00e3o em separado foi de emenda do deputado Alexis Fonteyne que, entre outras mudan\u00e7as, propunha que os estados usassem apenas um crit\u00e9rio para o c\u00e1lculo do ICMS, fazendo refer\u00eancia somente \u00e0 al\u00edquota efetiva ou \u00e0 al\u00edquota nominal.
