{"id":20241,"date":"2021-11-22T09:54:56","date_gmt":"2021-11-22T12:54:56","guid":{"rendered":"http:\/\/bonettiassociados.com.br\/?p=20241"},"modified":"2021-11-22T09:54:56","modified_gmt":"2021-11-22T12:54:56","slug":"tributacao-de-vgbl","status":"publish","type":"post","link":"http:\/\/bonettiassociados.com.br\/index.php\/2021\/11\/22\/tributacao-de-vgbl\/","title":{"rendered":"TRIBUTA\u00c7\u00c3O DE VGBL"},"content":{"rendered":"<p style=\"text-align: justify;\"><span style=\"font-family: arial, helvetica, sans-serif;\">A 2\u00aa Turma do Superior Tribunal de Justi\u00e7a (STJ) definiu que os valores a serem recebidos pelo benefici\u00e1rio, em decorr\u00eancia da morte do segurado contratante de plano VGBL, n\u00e3o integram a heran\u00e7a.<\/span><\/p>\n<p style=\"text-align: justify;\"><!--more--><\/p>\n<p style=\"text-align: justify;\"><span style=\"font-family: arial, helvetica, sans-serif;\">Portanto, n\u00e3o se submetem \u00e0 tributa\u00e7\u00e3o pelo Imposto sobre Transmiss\u00e3o Causa Mortis e Doa\u00e7\u00e3o (ITCMD). Em decis\u00e3o un\u00e2nime, os ministros negaram recurso em que o Estado do Rio Grande do Sul defendia a exigibilidade do ITCMD sobre os valores aplicados em VGBL ap\u00f3s a morte do contratante. Em primeiro e segundo graus, foi reconhecida a ilegalidade da cobran\u00e7a. Ao STJ, o Estado alegou que, com o falecimento do titular da aplica\u00e7\u00e3o, h\u00e1 transmiss\u00e3o dos investimentos acumulados aos herdeiros, caracterizando-se o fato gerador do tributo.
