Trata-se de um tema caro para as empresas &#8211; principalmente as do setor varejista.<\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"font-family: arial, helvetica, sans-serif;\">O an\u00fancio do adiamento foi feito no come\u00e7o da sess\u00e3o, pouco depois das 14h, e n\u00e3o h\u00e1 informa\u00e7\u00f5es ainda sobre uma nova data de julgamento. A ministra \u00e9 a relatora do processo (EREsp 1428247)<\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"font-family: arial, helvetica, sans-serif;\">A discuss\u00e3o, nesse caso, \u00e9 se a parcela referente ao ICMS &#8211; Substitui\u00e7\u00e3o Tribut\u00e1ria (ST) pode ser contabilizada como cr\u00e9dito. A Receita Federal defende que n\u00e3o. Se atendida pelos ministros, as empresas ter\u00e3o direito a menos cr\u00e9ditos e, consequentemente, a conta de PIS e Cofins a pagar \u00e0 Uni\u00e3o ficar\u00e1 maior.<\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"font-family: arial, helvetica, sans-serif;\">A 1\u00aa Se\u00e7\u00e3o uniformiza o entendimento que deve ser adotado nas turmas de direito p\u00fablico do STJ &#8211; por isso a import\u00e2ncia do julgamento.
