A novidade consta no Ajuste Sinief n\u00ba 16\/2020.<\/span><!--more--><\/p>\n<p style=\"text-align: justify;\"><span style=\"font-family: arial, helvetica, sans-serif;\">Importante ressaltar que v\u00e1rios Estados est\u00e3o desembarcando do regime de substitui\u00e7\u00e3o tribut\u00e1ria, regime em que a responsabilidade pelo pagamento do Imposto sobre Circula\u00e7\u00e3o de Mercadorias e Presta\u00e7\u00e3o de Servi\u00e7os \u2013 ICMS sob as opera\u00e7\u00f5es de vendas de mercadorias ou presta\u00e7\u00f5es de servi\u00e7os \u00e9 atribu\u00edda a outro contribuinte que n\u00e3o \u00e0quele respons\u00e1vel pela venda do produto.<\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"font-family: arial, helvetica, sans-serif;\">O Estado de S\u00e3o Paulo, por exemplo, retirou o vinho do ICMS-ST a partir de 1\u00ba de fevereiro de 2020.<\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"font-family: arial, helvetica, sans-serif;\">Em 2016, o Supremo Tribunal Federal \u2013 STF determinou que o contribuinte tem direito a devolu\u00e7\u00e3o do ICMS se o valor devido no momento da venda for menor do que o previamente recolhido antecipadamente atrav\u00e9s da substitui\u00e7\u00e3o tribut\u00e1ria.
