Assim, a 7\u00aa Turma do Tribunal Regional Federal da 1\u00ba Regi\u00e3o reintegrou um s\u00f3cio-administrador de uma empresa a uma execu\u00e7\u00e3o fiscal.<\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"font-family: arial, helvetica, sans-serif;\">Na primeira inst\u00e2ncia, a penhora de um im\u00f3vel residencial havia sido desconstitu\u00edda e o s\u00f3cio havia sido exclu\u00eddo do polo passivo da a\u00e7\u00e3o. A Fazenda Nacional recorreu, alegando a penhorabilidade do im\u00f3vel e a legitimidade do s\u00f3cio.<\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"font-family: arial, helvetica, sans-serif;\">Como o nome do s\u00f3cio constava da CDA e &#8220;na aus\u00eancia de elementos que afastem a presun\u00e7\u00e3o de legitimidade do t\u00edtulo executivo em comento&#8221;, a desembargadora Gilma Sigmaringa Seixas, relatora do caso, reformou a senten\u00e7a e o incluiu de volta na execu\u00e7\u00e3o.<\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"font-family: arial, helvetica, sans-serif;\">Apesar disso, a magistrada constatou que o im\u00f3vel em quest\u00e3o de fato constitui bem de fam\u00edlia, e por isso reconheceu sua impenhorabilidade. Seu voto foi acompanhado por unanimidade.
