Segundo o enunciado, &#8220;o crime de fraude \u00e0 licita\u00e7\u00e3o \u00e9 formal, e sua consuma\u00e7\u00e3o prescinde da comprova\u00e7\u00e3o do preju\u00edzo ou da obten\u00e7\u00e3o de vantagem&#8221;.<\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"font-family: arial, helvetica, sans-serif;\">O texto aprovado, que teve como refer\u00eancia o artigo 90 da Lei 8.666\/1993, al\u00e9m de julgados da 5\u00aa e da 6\u00aa Turmas sobre o tema, servir\u00e1 de orienta\u00e7\u00e3o para toda a comunidade jur\u00eddica sobre a jurisprud\u00eancia do tribunal.<\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"font-family: arial, helvetica, sans-serif;\">Conforme previs\u00e3o do artigo 123 do Regimento Interno do STJ, o enunciado ser\u00e1 publicado no Di\u00e1rio da Justi\u00e7a Eletr\u00f4nico, por tr\u00eas vezes, em datas pr\u00f3ximas.
