A a\u00e7\u00e3o foi distribu\u00edda ao ministro Nunes Marques.<\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"font-family: arial, helvetica, sans-serif;\">De acordo com os Decretos estaduais 65.254\/2020 e 65.255\/2020, as isen\u00e7\u00f5es valem exclusivamente para opera\u00e7\u00f5es destinadas a hospitais p\u00fablicos, santas casas e entidades beneficentes e assistenciais hospitalares.<\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"font-family: arial, helvetica, sans-serif;\">A Anahp alega que os dispositivos violam o artigo 155, par\u00e1grafo 2\u00ba, inciso XII, al\u00ednea \u201cg\u201d, da Constitui\u00e7\u00e3o Federal, que estabelece que cabe \u00e0 lei complementar regular a forma de concess\u00e3o e de revoga\u00e7\u00e3o de isen\u00e7\u00f5es, incentivos e benef\u00edcios fiscais relativos ao ICMS, mediante delibera\u00e7\u00e3o dos estados e do Distrito Federal.
