No caso concreto, o Tribunal de Justi\u00e7a de S\u00e3o Paulo (TJ-SP), ao manter decis\u00e3o de primeira inst\u00e2ncia, assentou que a Companhia de Desenvolvimento Habitacional e Urbano do Estado (CDHU) tem direito \u00e0 imunidade do Imposto sobre a Propriedade Predial e Territorial Urbana (IPTU). Visando a reforma dessa decis\u00e3o, o munic\u00edpio de S\u00e3o Paulo interp\u00f4s recurso extraordin\u00e1rio, que teve a remessa ao Supremo inadmitida pelo TJ-SP.
