{"id":13428,"date":"2020-11-30T10:18:29","date_gmt":"2020-11-30T13:18:29","guid":{"rendered":"http:\/\/bonettiassociados.com.br\/?p=13428"},"modified":"2020-11-30T10:18:29","modified_gmt":"2020-11-30T13:18:29","slug":"mesmo-fato-gerador-se-ha-isencao-de-ipva-por-furto-df-nao-pode-cobrar-licenciamento-e-dpvat-diz-stj","status":"publish","type":"post","link":"http:\/\/bonettiassociados.com.br\/index.php\/2020\/11\/30\/mesmo-fato-gerador-se-ha-isencao-de-ipva-por-furto-df-nao-pode-cobrar-licenciamento-e-dpvat-diz-stj\/","title":{"rendered":"MESMO FATO GERADOR &#8211; SE H\u00c1 ISEN\u00c7\u00c3O DE IPVA POR FURTO, DF N\u00c3O PODE COBRAR LICENCIAMENTO E DPVAT, DIZ STJ"},"content":{"rendered":"<p style=\"text-align: justify;\"><span style=\"font-family: arial, helvetica, sans-serif;\">Governo do DF inscreveu contribuinte na d\u00edvida ativa por falta de pagamento de licenciamento e DPVAT de carro roubado.<\/span><!--more--><\/p>\n<p style=\"text-align: justify;\"><span style=\"font-family: arial, helvetica, sans-serif;\">Se o Departamento de Tr\u00e2nsito recebe a not\u00edcia do furto de um ve\u00edculo e efetua o cancelamento da cobran\u00e7a do IPVA, cabe ao estado ou Distrito Federal cancelar, tamb\u00e9m, a cobran\u00e7a das demais taxas e d\u00e9bitos gerados pela propriedade do ve\u00edculo, independentemente da requisi\u00e7\u00e3o do contribuinte.<\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"font-family: arial, helvetica, sans-serif;\">Com esse entendimento, a 1\u00aa Turma do Superior Tribunal de Justi\u00e7a negou provimento ao recurso ajuizado pelo governo do Distrito Federal, contra decis\u00e3o que determinou a exclus\u00e3o dos d\u00e9bitos referentes \u00e0 taxa de licenciamento anual do ve\u00edculo e ao seguro obrigat\u00f3rio da d\u00edvida ativa.<\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"font-family: arial, helvetica, sans-serif;\">Ao ser informado do furto, o Detran do Distrito Federal deferiu o pedido de isen\u00e7\u00e3o de IPVA, com base no artigo 1\u00ba, par\u00e1grafo 10\u00ba da Lei 7.431\/1985. Assim, caberia ao governo distrital cancelar a cobran\u00e7a das demais taxas e d\u00e9bitos gerados pela propriedade do ve\u00edculo, o que n\u00e3o ocorreu no caso.<\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"font-family: arial, helvetica, sans-serif;\">&#8220;Em que pese a inexist\u00eancia de previs\u00e3o legal sobre a isen\u00e7\u00e3o e\/ou remiss\u00e3o do seguro obrigat\u00f3rio e do licenciamento anual, \u00e9 certo que ambos possuem o mesmo fato gerador do IPVA, ou seja, a propriedade do ve\u00edculo.
