Essa foi a tese fixada pelo STF, em julgamento de recurso especial pelo Plen\u00e1rio virtual, em sede de repercuss\u00e3o geral.<\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"font-family: arial, helvetica, sans-serif;\">A Constitui\u00e7\u00e3o prev\u00ea imunidade de ICMS sobre &#8220;opera\u00e7\u00f5es que destinem mercadorias para o exterior&#8221; (artigo 155, par\u00e1grafo 2\u00aa, inciso X, &#8220;a&#8221;). Mas assegura a &#8220;manuten\u00e7\u00e3o e o aproveitamento do montante do imposto cobrado nas opera\u00e7\u00f5es e presta\u00e7\u00f5es anteriores&#8221;.<\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"font-family: arial, helvetica, sans-serif;\">Assim, ao negar provimento ao recurso, o relator do caso, ministro Dias Toffoli, entendeu que a imunidade n\u00e3o abrange toda a cadeia produtiva do bem exportado. Opera\u00e7\u00f5es anteriores \u00e0 venda do produto ao exterior, como compra e venda de mat\u00e9ria-prima, est\u00e1 sujeita a essa tributa\u00e7\u00e3o.<\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"font-family: arial, helvetica, sans-serif;\">Foi fixada a seguinte tese para o tema 475:<\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"font-family: arial, helvetica, sans-serif;\">&#8220;A imunidade a que se refere o art. 155, \u00a7 2\u00ba, X, &#8220;a&#8221;, da CF n\u00e3o alcan\u00e7a opera\u00e7\u00f5es ou presta\u00e7\u00f5es anteriores \u00e0 opera\u00e7\u00e3o de exporta\u00e7\u00e3o&#8221;.<\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"font-family: arial, helvetica, sans-serif;\">Toffoli foi acompanhado por oito ministros.
