{"id":10737,"date":"2020-07-27T11:22:09","date_gmt":"2020-07-27T14:22:09","guid":{"rendered":"http:\/\/bonettiassociados.com.br\/?p=10737"},"modified":"2020-07-27T11:22:09","modified_gmt":"2020-07-27T14:22:09","slug":"competencia-concorrente-tj-sp-valida-lei-municipal-que-isenta-de-iptu-os-portadores-de-doencas-graves","status":"publish","type":"post","link":"http:\/\/bonettiassociados.com.br\/index.php\/2020\/07\/27\/competencia-concorrente-tj-sp-valida-lei-municipal-que-isenta-de-iptu-os-portadores-de-doencas-graves\/","title":{"rendered":"COMPET\u00caNCIA CONCORRENTE &#8211; TJ-SP VALIDA LEI MUNICIPAL QUE ISENTA DE IPTU OS PORTADORES DE DOEN\u00c7AS GRAVES"},"content":{"rendered":"<p style=\"text-align: justify;\"><span style=\"font-family: arial, helvetica, sans-serif;\">A iniciativa legislativa em mat\u00e9ria tribut\u00e1ria, ainda que se trate de incentivo fiscal, \u00e9 concorrente entre os Poderes Legislativo e Executivo.<\/span><!--more--><\/p>\n<p style=\"text-align: justify;\"><span style=\"font-family: arial, helvetica, sans-serif;\">Com esse entendimento, o \u00d3rg\u00e3o Especial do Tribunal de Justi\u00e7a de S\u00e3o Paulo validou uma lei municipal de Salmour\u00e3o, de iniciativa parlamentar, que prev\u00ea isen\u00e7\u00e3o do IPTU a portadores de doen\u00e7as graves, como insufici\u00eancia renal cr\u00f4nica e paralisia cerebral.<\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"font-family: arial, helvetica, sans-serif;\">O colegiado apenas declarou inconstitucional o prazo de 60 dias para regulamenta\u00e7\u00e3o da norma por viola\u00e7\u00e3o ao princ\u00edpio da separa\u00e7\u00e3o dos Poderes. Segundo o relator, desembargador M\u00e1rcio Bartoli, n\u00e3o h\u00e1 que se confundir o conte\u00fado da lei impugnada com mat\u00e9ria or\u00e7ament\u00e1ria, ato ou lei cuja iniciativa seja reservada \u00e0 administra\u00e7\u00e3o.<\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"font-family: arial, helvetica, sans-serif;\">&#8220;A lei impugnada estabelece a isen\u00e7\u00e3o tribut\u00e1ria de maneira gen\u00e9rica a todos aqueles contribuintes que se adequem aos seus requisitos.
