Com esse entendimento, o ju\u00edzo da 12\u00aa Vara Federal de S\u00e3o Paulo, que consta no artigo 151 do C\u00f3digo Tribut\u00e1rio Nacional, decidiu suspender a exigibilidade do cr\u00e9dito tribut\u00e1rio, bem como impediu que a Receita pratique qualquer ato em desfavor de um empres\u00e1rio.<\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"font-family: arial, helvetica, sans-serif;\">O caso trata de uma autua\u00e7\u00e3o contra s\u00f3cio de empresa que teria distribu\u00eddo lucros quando a companhia possu\u00eda d\u00e9bitos fiscais.<\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"font-family: arial, helvetica, sans-serif;\">Atualmente o processo administrativo encontra-se no Conselho Administrativo de Recursos Fiscais (Carf).
